resignation & no salary

Company failed to pay all staff salary/kwsp/income tax/socso for few months until today and staff decided to tender resignation and asking management to waive the notice period(All staff is still on probation period, in our letter there is no clause saying we need to give notice during probation period)

  1. Can staff submit resignation and leave?
  2. what happens to staff who have yet to resign? company still owe them money until company terminate them officially in writing?

I think it would be better for all of you who are affected to personally go to the Labour Department and make a complaint against the company for not paying your salary.

refer to Employment act , section 13 (2) :-
Either party to a contract of service may terminate such contract of service without notice in the event of any wilful breach by the other party of a condition of the contract of service.

So just give resignation letter and straight away go to JTK
