Hi,

I would like to seek for advise on this issue.

My employer has asked my colleague to leave the company immediately without giving any compensation and no notice period is given. He was given a reason that he did not perform well but there were no written warning or show cause letter being issued to him. He's a confirmed staff of the company. Reason for the company to ask him to leave early is because his position has a huge access in the system can company is worried that he may harm the customer or stealing company data. It has been stated clearly in the employee handbook that upon termination by either party need to serve 1 month notice or salary in lieu.

Please advise if the employer can do such act. Thanks in advance.

He should personally go to the Labour Department and lodge a complaint there.
