Dear KL Siew,
In my contract there is a fixed bonus, tied to 2 years of continuous employment. I have finished my 2 years contract in the middle of December. During my employment I had a period when I was sick and had to deal with other family issues, so my performance was poor. I got a warning letter to rectify my performance, otherwise they will take actions and may cancel my bonus. After this period my performance got better and we even signed another 2 years to continue with the company, which implies that they want to keep me.
But my boss now says that I'm still missing some performance points, so he doesn't want to issue the bonus.
My question is, that in light of that warning letter, can they really forfeit the bonus and not even giving me any notice or letter about it?
It is quite a large sum...
Thank you for your help!
I am afraid that you may have to bring the matter up with the Labour Department. Bring along the contract of service especially about bonus payment. Let them look into the matter.
