We have issued a warning letter to Staff A and since then she has refused to perform any of her duties. She clocks in and out punctually but just sits there not doing any work. We issued her a warning letter on the basis on non completion of work. She did not post, verify and issue payments to our vendors for the past 6months even after being reminded to do so. This is part of her JD which she is very well aware of. She is also one of the longest serving staff in the office which has been performing the same tasks for the past few years.

After she was issued the warning letter, she told a few of the other colleagues that she has opened a file at the Labour Office and is waiting for bonus to "decide if she wants to continue to work here"

We are to release 13th month salary next week, and bonus before Chinese New Year, we would like to find out of Staff A is still eligible for 13th month salary and the bonus that is coming up.

Thank you for your advise

She can be terminated on the ground of "insubordination" and bonus including 13th month bonus is not compulsory unless you stated in the LOE and making it a contractual bonus.
