We have a staff A fighting with staff B in workplace. We are planning to do domestic inquiry and proceed with termination to staff A & suspension staff B for 2 weeks.I would like to discuss staff A termination issue. We have issue 2 warning letter before.1st warning letter absent meeting without inform but without staff A acknowledge2nd warning letter issued upon we received his explanation letter ( we did issue him show caused). Due to not follow law set by government & not taking employer instructionsMy question is can we terminate him immediately without paid him termination benefits? Terminate with reason safety threat to others. An employee obligation must co-workers to keep each other safe from serious injury or death.Kindly need your advice.

Since you are planning to do a DI, then do it and decide accordingly. It is better to conduct DI first instead of just summary dismissal unless the offence is very serious, you only know.

Ya planning for DI. Staff A actually have serious attitude problem strong personality and not taking any advice & instructions. We have witness for this case wish to take this opportunity to terminate him without compensation benefits. May be still will serve him notice to give sufficient time to him get another job.He is smart what I'm concerned he will go IR request for compensation benefits & sue us unfair dismissal.
