I have joined this company since 19th sept, 2016, but just before my three months probation period due, the company facing cashflow problem, retrenched many staff, and has asked me to submit my resignation since i have yet confirm.
for this case, do i entitle any pro-rata annual leave ?
It is unlawful for the Company to ask you to tender resignation. If the Company wants you to leave then it can terminate you on the ground of redundancy and they have to justify it.
As for the Annual leave entitlement, yes, you are entitled to the pro-rated provided that you are covered by the EA or else, I guess it's up to the Company.
