Hi all . I wanna ask about my boss told me that MALAYSIA DAY, DEEPAVALI and CHRISTMAS all worker must work because this 3 days pb holiday are replace to CHINESE NEW YEAR. First and second day of CNY are pb holiday but our company rest until 5 day , so 3,4,5 are unpaid leave ,but he say that if we work on malaysia day, deepavali and christmas then 3 days will be replace to CNY (3,4,5), he didn't ask about employee 's opinion and just inform us like that. Isn't illegal?
In my opinion, Malaysian Day is one the compulsory public holiday under the Employment Act, it cannot be replacement. The other two public holidays can be replaced. You may consult the Labour Department and get their official views about your questions.
