I would like to get your advise on a staff resignation.
We have a staff who has tendered her resignation on 7/12/16 and her one month prior notice is until 6/1/17. She has 6 days of annual leave left til 31/12/16 and hence after deducting her annual leaves, she is supposed to work until 28/12/16. But she told me she has to start her new job at new company on 27/12/16.
If she insists to work until 23/12/2016, is thee any penalty to her? or just calculate her salary until 23rd?
PS: She only told me about this after her tender of resignation because she wants to know when is her last day of work
You can pay her up to 23 Dec but you must pay back 6 days salary for the 6 days annual leave balance. Also consult the Labour Department see what they say.
