Hi, I am an engineer currently working for an engineering company. Our work is mainly site based. Overtime is calculated at a flat rate of RM7 for those whose salaries are above RM2000 per month. I understand that according to the first schedule, OT is up to the management if salaries are above RM2000 but most of us engineers and supervisors are usually at site looking over the work done by our contractors. I would like to ask, in this case is the company wrong for not giving us our 1.5X OT rate? Thank you.
To me, RM7 per hours of OT is too low. what you can do is to try to negotiate with the company for a better deal. If you really want to know whether you are covered under the Employment Act or not, I would suggest that you pay a personal visit to the Labour Department and discuss the matter with the officer by giving more details about the actual nature of your work.
