Notice of Termination

Hi,

We have a staff who joined us on 16th Apr  2016 and his probation period is 6 months. He is not performing for the past 6 months (task given incomplete) we decided to terminate him in end of sep 2016 and now he is asking for compensation of 2 months salary.

In the offer letter is stated:

During the probation period, either party may terminate this contract by giving One (1) month’s written notice, or pay in lieu of notice without any reasons being assigned.
Upon confirmation of employment, either party may terminate this contract by giving to the other party:
• Managerial level: Three (3) months’ written notice of termination of contract or pay in lieu of notice an indemnity equivalent to the period of notice. The last drawn salary of the employee shall determine such sum.
• Executive level: Two (2) months’ written notice of termination of contract or pay in lieu of notice and indemnity equivalent to the period of notice. The last drawn salary of the employee shall determine such sum.

Do we need to pay him?
