Resigned staff claim for annual leave

Hi,

One of the staff resigned and her last day will be 13 Sept.  She wanted to claims her annual leave till Dec 2016.  Is that a labour law said that she leave need to court until dec 2016.

Our company leave court by quarterly, mean Jan-Mar, April-June, July-Sept, Oct-Dec, each of the quarter 3 days, if you take more than 3 days, is consider on unpaid leave.

This staff has finished her leave before resignation letter, means she never work on Oct until the end (dec).  Company has right not to give me 3 days annual leave?  How about Labour law say on this issue?  Please help.
