Annual Leave and Medical Leave during probation period

Hi,

I have staff that joined work on 1st april and 6 month probation. His salary is below RM2000.00. Is it this staff entitled to AL and MC during his probation? Since joined and until now (5 MONTHS) this staff already taken 8 days annual leave and 1 day MC. I need ur advice.

Annual Leave - Depends on the Company's policy but general practice in the market doesn't allow the staffs to use their AL during the probation period.

Medical Leave - Yes, he is entitle to it.

If his salary is below RM2k, he's definitely covered by the EA.

If that means the company have to give him Annual leave during his probation period because covered by EA?

Yes but whether or not he can utilize the leave during the probation period, it depends on the Company's policy.
