Maternity Leave

Hi Siew,

I would like to know:

1) If the Employment Act 1955 is applicable to my case with a basic salary of > RM1,500.

2) If public holidays are included in the 60 days maternity leave or it can be substituted on other days.

As for my case, there are 5 public holidays fall during the period between August to October. I am bound to a service of contract. The contract stated Maternity leave is considered as part of the 60 days paid sick leave in each year if hospitalisation is necessary.

3) Am I entitled to allowance on top of my basic salary during the leave period?

1. The Act covers non manual employees with salary not more than RM2000.

2. Maternity leave includes all public holiday or rest days.

3. It should include if the allowance is a fixed allowance.
