What is the entitlement of medical leave for employee who have earned more than RM5000 and not covered by labour law? Does the employee entitle for the same number of days as spelled out in labour law? If not which law should we refer to? Can we give lesser than what spell out in labour law?
In such cases, the employees concerned should refer to the terms and conditions in their own contract of service with their employer. If these employees are willing to accept unfavourable terms, it is just too bad, only themselves to blame. However, employers must be fair, don't try to short change, not a good practice. They wont get good employees that way.
