Procedure of termination of an employee from emplymemt

Dear Admin,

We would like to termination of an employee from the company but this employee is worked with us for more than 5 years.Throughout the employment she is not performing well but because she know how to take care of her manager so she able to stayed for so long.Any now all her manager has left the company.And we plan to remove her but we want to find a proper way without allowing her to challenge us to labour department later.She is handling of HR and Admin in the company and now our company want to combine the works.Company would like to merge this department with finance,which means we want someone who can handle accounting,HR and admin.But she don't know accounting.Her work attitude also bad and not fulfilling her role and work given.

Please advise how can we terminate her from the company.

1. You can give notice for termination of service and also pay termination benefits according to the Employment(Termination and Layoff Benefits)Regulations.

2. If she thinks the termination is unfair, she has the right to bring the matter up with the Industrial Relations Department and makes a claim for reinstatement.
