Unpaid Leave Deduction for Hospitalization More Than 60 Days

Hi,

I have an employee has been fully utilized the 60 days of Hospitalization by 7th March 2016. 

Can i deduct 8th March to 31st March  as unpaid leave on March salary? 

But as i know the deduction from wages must not exceed 50% of the employee salary. 

Please advise if i can direct deduct all the 24 days as unpaid leave?

That will be no salary at all for that period. There is no provision in the EA for half pay leave after all available  leave has been exhausted.

That means the concept of "deduction from wages must not exceed 50% of the employee salary. " doesn't apply in this scenario. 

So the employee will not get his salary for March.

From 1 March to 7 March, he still gets salary as he was on sick/hospitalisation leave with pay. Still no sure, you can give a call to the Labour Department and get confirmation.
