Confirmation letter

Dear Sir,

1) I wish to know if the company did not issue the confirmation letter to the staff after the due date, should the staff consider them a confirmed staff ?

2) How long should the probation periods extend ? for example after 6 months probation periods, need to extend for 3 months, and if the staff still cannot perform to the expectation and  the company want to give another change, can the company extend the next 3 months ?

1. Can refer to a Court decision for some info.

2. Can be extended to a period the employer thinks suitable for the employee to improve.
