Resign matter

a) I have got job that requires me to join on 1st.Sept, however my present company's last day is 16th Sept.My HR informed me that I can't be employeed in two places in one time.In this case, can i apply leave or settle with my leave including sat & sun ?

b) My Basic Salary $4k & allowance $1.5k, if my balance replacement leave is 26 days. how do i calculate my rate/day

Under the Employment Act, an employee is entitled to take all his available annual leave before his goes. Under the Act, leave pay calculation per day is salary/26.

You are not covered by the Employment Act, but you may use it as guide. Discuss with your present HR. whether (1) allow you to pay indemnity from 1 Sept to 16 Sept and the company to pay you 26 days annual leave balance at (5500/26) per day or (2) allowance clear all your leave before you leave on 16 Sept.

If the matter cannot be worked out nicely, you may consult the Industrial Relations Department.
