Employment (termination and lay off benefits) 

1. Date Joined 08.02.2011 , Basic Salary RM 1960.00 , Termination 31.01.2016, Service for 4 year 11 month (till End Jan 2016).

Termination Benefit = RM 1,960.00 x 12 / 365 x 15days x 4 year = RM 3,866.30

Pro-Rate for period less than a year = RM 1,960.00 x 12 / 365 x 11month /12 = RM 59.06

Total is RM 3,925.36

Does my calculation correct ?  Please advise if my calculation is wrong.

Hi Admin,

My husband worked as Site Supervisor under construction company and her salary is RM 3250/month.  I understand that he's not cover under Emp Act.  He was terminated by the company with 1 month notice as per letter of offer.  This is due to the company having financial problem.

Is there any way to get compensation from the company.  Please advise.

In that case, I think you should tell your husband to approach the local Industrial Relations Department for help. He should do it within 60 days from date of termination of service.
