Work on Compulsory Public Holiday, Nation Day (Hari Merdeka)

Hi there,

Hari Merdeka is one of compulsory public holiday in Malaysia.

  1.  Company ask their employee (full time position, salary more than RM2000) work on Hari Merdeka, is that the company should pay (salary/26) x 2 or two days replacement?
  2. What if these company deny to pay (salary/26) x 2 or two days replacement for those who still need work on Malaysia compulsory public holiday , what we can do? Can employee sue them or report to Labour Law?
  3. Let say the working hours is 10:00am-7:30pm, employer ask their employee overtime work untill 12am, or late than that, can employee make report by labour law?
  4. Salary more than RM2000, less than RM5000, is there covered by any act of labour law?

As far as the Employment Act is concerned, your employer looks like he is not following the law.

Since, as you said, your salary is more than 2k but below 5k, you can consult the local Labour Department whether there is a possibility of giving you some help in the matter.
