Contribution under probation period

Dear Sir / Madam,

May I know is it legality to sign an employment letter with staff with a statement of "no EPF and SOCSO contribution under probation period"? The employer will not contribute EPF and SOCSO for the staff under probation period and will not deduct any contribution from the salary as well. 

The staff is agreed with the company policy and signed the employment letter!

Can the staff sue the employer on not contribute the EPF and SOCSO for him?

That clause is not valid. Consult EPF and SOCSO for official confirmation.
