Deduction on Final Salary

Hi,

I would like to get your advice whether we can deduct the staff salary who has resigned for the reason of misled information during his service which lead to the loses to the Company.

His salary is more than RM 2,000.00.  Upon his resignation, he has signed a letter of indemnity saying that he is liable to the Company loses if we found he caused the damages and loses to the Company or the third party for the projects that he has been following up.

He has left now and the management found out he has underquoted a project - caused loses to the Company. The management decided to deduct his salary for the mistake he made

I am just as unsure as you are. Consult your company lawyer before you do that.
