holding staff salary until a punishment has been decided by Disciplinary Committee after Domestic Inquiry

Dear Sir,

I have one question whereby a staff has been suspended for his misconduct and later a Domestic Inquiry has been held upon him in January 2015. The punishment is still pending by the Disciplinary Committee. Can the management hold the said staff salary ( ie, January 2015 salary ) until the punishment being made upon him?

Would appreciate if u can give your feedback on this matter therein.

I would never recommend holding back an employee's salary, even if he is on suspension. The usual practice is to suspend with full pay and thereafter if there is an extension of the suspension period, it can be on half pay. This should be clearly stipulated in the suspension notice.
