Annual leave calculation

Would like to know how many days for the annual leave entitlement end of this year. i joined a company on 01 September 2013. My probation period is 3 months. And the offer letter stated:

" Paid annual leave shall be in addition to Rest days, Paid Holidays and sick leave. Subject to review by the firm, you are entitled to paid annual leave after confirmation in any calendar year as follows:

- Twelve (12) days for each year of service (or any proportion applicable to that year of service) and one (1) additional day of every subsequent year of service until the ceiling of eighteen (18) days.

For the purpose of calculation, leave entitlement commences from the confirmation of employment in the first year of service and from 1st January of each subsequent year of service. "

If the employee is covered by the Employment Act, annual leave entitlement should begin from the time of joining and not after confirmation. If he is not covered by the EA, the condition set by the company can be valid.

in this case, didn't you mean that i can only entitled 9 days paid annual leave instead 12 days from 01.09.2013 to 31.08.2014?

Mind to give me a clear guideline?

Are you covered by EA (meanng your salary is not more than RM2000), your leave entitlement is mentioned in Section 60E of the EA.

If your salary is more than RM2000, you may have to follow the policy of the company. If the policy says leave entitlement only start after confirmation, that's it.
