Annual Leave after termination

offer letter stated: "You are entitled 12 days paid annual leave for every twelve months of continuous service"

(there is no others rules & regulation regarding annual leave) 

i terminated service with the company after 9 months and is still under probation period.

the offer letter does not stated only confirmed staff entitled to annual leave. however the company didn't pay back pro-rated annual leave to me. 

is this legal? 

i would like to ask how to calculate pro rated annual leave too?

Since the company did not pay you your prorated leave entitlement, I can go and make a claim for it at the local Labour Department. I must go there personally.

Hi, thanks for your reply, but i am non manual worker, and salary over RM2000 is this i am still qualify to claim for it at the local Labour Department? what document should i bring along?

In that case, I think you can make a telephone call first and talk to the duty officer about your case rather than going there in person.
