I worked in an outsource company named (A), and I provided service in a company (B), and I resigned and my last day was on 31 Oct 2014. Till now, the company (A) didn't pay me my October salary yet, the reason is an issue arised between company (A) and (B) about my service contract. Company (A) can't charge my service payment over company(B), and company (B) refused to ay company (A).

What can I do now?

1) Can I sue company (B)?

2) If yes, how to sue? I am earning >RM5000 per month.

Thanks.

Or can I sue company (A) instead?

In my offer letter, there has no such rule to say that company (B) must pay company (A) in order to me to receive my paycheck. It is unfair to withhold my salary because of the service contract issue between both company.

Thanks.

Consult a lawyer, showing him whatever contract you have signed.
