Medical Leave/ Claim

Hi administrator,

My company is entitled to claim for medical leave and medical claim after staff's confirmation. Is that any act stated that company should given medical leave and medical claim for new joining employee?

The Employment Act requires employers to provide medical leave with pay but does not require them to pay medical claims. Medical claims entitlement are benefits given by individual companies at their discretion.

Hi administrator,

If we stated clearly that "Confirmed Employee shall be eligible for paid medical leave according to the length of services"  in the Appointment Letter and then the new staff already signed it, is company can do in this way? is that any wrong of the company since already breach of the employment act.

The clause is not valid as far as the EA is concerned. When there is a law to provide something, employer cannot make their own rules that run counter to the law.
