My staff started working in the company since November, 2011. She is not entitled to any annual leave during her probation until the company confirmed her in January, 2012. She has 8 days of annual leave once confirmation. Please see as below:-

November - December 2011 - NIL

January - December 2012 - 8 days AL

January - December 2013 - 8 days AL

January - December 2014 - 12 days AL

From January-May 2014, she has applied and used 10 days of her annual leave and she tendered her resignation on June, 2014.

My question is, in the event of she resign from the company in mid of the year, does she still entitle for 12 days of AL in the same calender year? Or do I calculate pro-rated, for instance, 12 days/12 month = 1day/month; she has work for 5 months, therefore leave entitlement for 2014 is 5 days.

Thank you and hope to hear from you soon.

You can prorate his annual leave to the number of completed months of service.
