Hi,

Let say if I was hospitalized and was given with 7 days of sick leave to recuperate by the registered panel hospital. However, if I to work during the sick leave(eg: Monday to Friday), do I entitle to get the annual leave(5 days) as replacement to the sick leave since I to work during the sick leave.

if the doctor give you 7 days sick leave, but you decided to come back to work on 5 of the sick leaves then your employer shall only deduct 2 days from your sick leave entitlement. You are deemed as not taken the sick leave, so it should not be replaced with annual leave. Please take note that depending on the nature of work, in many cases HR will not allow those with valid sick leave to be present at work. The consequences and risks are bigger if anything happen to the employee while working because the employee is certified by a doctor as not fit to work on that day.
