Annual leave balance deduction after tendered resignation

Hi,

I have tendered my resignation since mid of February, and I am currently serving 2 months notice full. 

I was entitled for 21days of annual leave annually, and I have taken 3 days leave before, therefore there were 18 days left before tendering my resignation. 

After my resignation, my leave entitlement is being reduced to 5 days in total, deducing the 3 days I have taken earlier, I have only 2 days left. I was being told that this is the standard procedure whereby resigned staff will get pro-rated annual leave entitlement. 

May I know if this is fair for me in accordance to the Malaysian labor law?

You can contact the Labour Department to get an official ruling on that.
