Hi,

I am a confirmed staff. My contract states:

" 4.1 Either party may terminate this contract upon confirmation by giving three (3) months' written notice or payment in lieu of notice."

I handed my resignation letter to my manager this morning and stated that I want to resign from my position effective immediately and I am well-prepared to make payment in lieu of notice. However, she is refusing to accept my resignation. She insists that it is "profesionalism" and "standard procedure" that I have to serve a certain amount of time before I leave. I argued that this is not what my contract states. She goes on to give an example, saying this has happened before and the company did not let the employee leave.

My question  is, am I entitled to make payment and just leave? I don't want to work here another day more.

Regards,

WC

Yes, you can do that, pay and leave.
