what if the company does not provide an employment contract?

Thre are two things:

1. If employees are covered under the EA, the terms and conditions of services in the Act are applicable to the employees whether there is written contract of service or not. However, under the Act, employers must give a written statement to the employees containing terms and conditions of service.

2. For employees not covered under the EA, meaning those with salary more than RM2000, they should know the terms and conditions of service offered by the employers or negotiate for proper terms and conditions of service like leave/sick leave entitlement etc. etc.
