Termination in Probation (extended period)

Dear All,

I have a staff that is still in probation until November due to poor attendance. The staff was always on EL and MC (without any copy of MC), not mentioning hard to reach via phone- always unreachable. After 3 months, we gave a letter notifying that his probation will be extended and stated the reasons. However, his performance is still the same and not up to our expectation. Can we terminate him while he is still in probation? In the offer letter, there is a clause that stated the staff or the company can terminate in giving 7 days notice. 

Can you give me your opinions?

You can terminate him with 7 days notice but he has the right to complain to the authority if he is not satisfied.
