Recently, company announced a new leave practice. Company has declared 7 Aug as Plant Shutdown in view of Hari Raya holiday on 8-9 Aug. The 7 Aug will be auto deduct employee's annual leave quota, no leave application form is required from employee (covered under Employment Act). Is this practice legal?
You may bring the matter up with the Labour Department if you want. However, if the majority of the employees has not problem with the practice, you may as well just follow and enjoy a longer Hari Raya holiday. This will also occur when the Chinese New Year comes.
