Hi,

Scenario 1; A employee reach the age of 55 this November and we plan to continue his service. Do we issue a new employment contract or the min retirement age limit order supersedes the current LOA?

Scenario 2; A employee reached the age of 57 & his employment contract ends this November and we plan to continue his employment. Do we need to issue a new LOA for the next 3 years(to fulfil the min retirement age limit) OR we have the option to keep continuing his employment contract on yearly basis?

In veiw of the new minimum retirement age law, I would strongly advise you to seek clarifications from the Labour Department. Discuss with officers there in greater details.
