Can my employer terminate my employment by giving me one month notice?

Dear Sir

I have a friend who is a foreign nurse working with a private hospital. Her employment contract was extended from September 2011 till September 2012. However, due to the company cost cutting, the employer now want her to go back by end July 2012 to her country by serving her a one month notice.

It is stated in the Termination Clause in her contract that either party is to give one month notice or one month salary in lieu to terminate the contract. However, her contract is a fixed term contract and she has not done any unlawful act for termination.

She understand from the embassy that the employer is to compesate her till the end of her contract if the termination if from the employer. Is this true and what is her right as a foreign nurse? Her salary is RM1900 per month plus fixed allowances.

We urgently need your advice as time is running out. Thank you

Apart from her own embassy, she can try approaching the local Labour Department or the Industrial Relations Department see whether she get some help from them.
