Termination due to excessive Medical Leave

Appreciate if anyone can assist me on this.


I have one staff who is always on medical leave. Everytime he on MC will be up to 1 month to 2 months a year. He have diabetic and done the operation to removed his 2 toes. Now he is on MC again for more than 2 weeks. 

What I can do about him? We does not wnt to terminate his service, but we really dont knw what to do as all his job is pending and this has jeopadised the operations. And now we dont know how long he will be on leave again. He always will utilised his 60 days hospitalisation entitlement and the 14 days MC entitlement. This has been go on for 2 years. This year will be the 3rd year and he is starting his MC again.

In his employment letter we did state that either party may give 1 month notice or in lieu of payment for the termination. Can we serve him this termination?

I would suggest you consult the Labour Department for some official advice before doing that. Youl may have to payment termination benefits to him. Go and talk to the Labour Department officers.
