Hi I would like to ask few question & hope u can help me clarify this few items. (retailing business)

1. Can employer force staff to do overtime and force the staff to transfer to another branch with short notice?

2. Can the staff has the right to refuse for above matter?

3. Can employer pay overtime on the next following month instead on the same month of salary paid? (credit to staff account n 7th day of following month but OT not paid together)

4. If employer pay salary on 7th day of following month, when is the exact time the salary should credited into the staff account. (ie morning or night)

5.the employer ask staff to be involve in an event which require the staff to work long hours & at the same time the staff got datelines to settle (ie proposal), therefore the employer decided not to pay OT due to the staff can't meet the datelines. what the staff should do?

Thank you.

1. Yes, the employer has to right to request employees to work overtime and also has the right to deploy his staff.

2. If every employee can refuse to work overtime, factories may have to close shop.

3. Sometimes, it works that way because time is needed to check through the punch cards especially when there is plenty of overtime.

4. The Employment Act says not later than the 7th day.

5. The staff can make complaint to the Labour Department. Similarly, if the staff are not happy with the employer\s practice in 1, 2, 3, 4 and 5, they can also complain to the Labour Department and let them look into the matter.
