Termination Terms and Condition

Would like to seek an advise based on following clause, whereby it stated on the Offer Letter under "Notice Period For Termination" section :-

"During probation, either party may terminate this contract of service by giving the other party one(1) month's written notice or one(1) month's pay in lieu of notice.

Upon confirmation, this contract of service can be terminated by either party giving the other party three(3) month's written notice or three(3) month's pay in lieu thereof"

My Question are,

1. What are the procedures the management could take action on if any employee who wish to resign by giving 1-month written notice?

2. Is there any ACTUAL Notice of Termination for all employee based on different level of position or grade?

You can take action to recover the indemnity from the employees from either the Labour Department or in civil court. Whatever the level, position or grade, whatever benefits are determined by the terms and conditions in the contract of service/appointment letter.
