Our company operates 5-day week (8:30am-5:30pm). We were required to work on weekends (10am-10pm) when we had an exhibition. We were granted replacement off-day (eg. 1 day granted for working on Saturday 10am-10pm) and allowance of RM20 per day with no overtime pay.

HR said that such replacement off-day is not applicable for encashment nor to offset resignation notice.

My colleague who joined the company for about 1 month, tendered his resignation, need to serve 1-week notice. He has 2 replacement off-days. He used 1 replacement off-day to offset the resignation notice and requested the company to pay him the balance 1 replacement off-day.

But the HR said that such replacement off-day is not applicable for encashment nor to offset resignation notice. Therefore that '1 replacement off-day to offset resignation notice' is to be considered as short-notice and the company can deduct 1 day of salary. Also the company refuses to pay him the balance 1 replacement off-day. Does the company have the rights to do these?

Your company may be right. Anyway, forget about the one day salary and go on with your new job, if any.
