Resignation, Balance Leave Calculation & Pay in Lieu

Hi,

I started working in this company since 1st July 2001. I am entitle for 22 days AL per year, and need to serve ONE month notice period.

I tendered my resignation on 30 Nov 2010, and my termination date is 29 December 2010. I have few question as below:-

1. How many days of AL I will entitle if my last day is 29 Dec 2010 since I do not serve for full year to get 22 days AL? Can you let me know the way of the calculation?

2. My new employer requested me to join on 16 Dec, and they are willing to pay the in lieu. In this case, how should we calculate the in lieu to pay?

1. Under the Employment Act, annual leave is based on complete month. Your company should be able to tell you, it may be prorated. I am not sure.

2. It is up to your current company to work out the amount . In your case, I suggest you have everything properly sorted out  with your current company before you go.

If I would like to pay an in lieu, does my current company has right not to accept it, and request me to stay until the last working day?

I do not want to have payment in lieu but want to take leave... How???
