I have a colleague who is advised by a hospital doctor to rest for 1 week, so she is given mc for 5 days, because we are off on saturday & sunday. But now our company hr said sat & sun have to deduct mc for 2 days. Pls. advise whether is it legal & in what circumstances our mc/hospitalisation hv to deduct for sat & sun (rest day)? Kindly reply asap. Thank you.

If Saturday and Sunday were included in the stretch of 5 days, the 2 days will be treated as your sick leave. The Employment Act does not state sick leave are for 'working days' only.

Why not also consult the Laobur Department?

If the scenario:

Doc said rest for 2 weeks (29 Oct-11 Nov), then back to work on 12 Nov. Then our off day is on sat & sun. Will that mean the company has the right to deduct either our sick leave/annual leave on 03, 04, 10, 11 Nov? But is that not logical to do so? As we are not working on sat & sun!!! Then is not fair to our working people. Then if we only mc 1 day on friday, back to work on next monday, then sat & sun we also hv to apply sick leave???

Can you give us contact no of labor office? Any office in Penang?OR any website we can submit question online?

Sorry, additional question.

As we got sick leave (with hospitalisation) & sick leave (without hospitalisation). Above example is sick leave without hospitalisation. Is it sat & sun is taken if sick leave (with hospitalisation)? How to define which sat & sun can be deducted for our hospitalisation?

Yes, I do understand your doubts. Better for both of you to get advice from the Labour Department. You can find the telephone numbers and address of the Labour Office, under the link "Telephone Contact Numbers" in the Home Page of this website.

Should you get an answer that sick leave should exclude restdays on Saturday and Sundary, please post a feedback here for the benefit of other readers.
