Our company currently provides medical expenses RM200 per year per worker, but not includes expenses regards industrial accident. (Before was no limit then cause abuse)
For the MC, only accept MC from panel and government clinic. When go for clinic, employee no need to prepare cash for payment, clinic will claims from us. Only have deduction in salary if medical expenses exceed rm200.
If the employee does not use up the rm200, remain medical expenses will not change into salary or bring to next year.
 
Now we plan to implement another way for medical benefit.
Medical expenses still rm200/year, not include industrial accident.
This rm200 will give on end of the year in salary.
Employee should paid 1st during visit clinic.
If the employee less visit to clinic, he will gain more.
However, panel clinic still apply. Still only accept MC form panel & government clinic.
 
Is there against any government rules?
Isn’t it only can apply for local employee, nope for foreign worker?(may caused FW avoid go to clinic for extra income)
We plan only the confirmed employee can take this benefit? Against rules?
If a employee resigned before confirm, will get nothing; resigned after confirm, gain medical benefit(RM200) by portion, isn’t ok?

There is no provision under the Employment Act regulating medical claims. It is up to individual employer. As to your proposed new method, it may cause problem those who have no money to go to see the panel doctor if their illness is genuine. Second, it may involve lots of effort to keep  proper records for each worker. Anyway, whatever you do, you better communicate clearly to the workers in order to avoid confusion.

If the staff during maternity leave when to see doctor, the medical fees of RM45 can be claimed?

The EA only says one who is on maternity leave shall not be entitled to sick leave.

Is there any labour law for those earning more than rm2k , but medical claims limited as per their employment grade...but very low..

Higher grade staffs above level 3 to level 1 would get family medical benefits with higher limits but those lower then level 3 would only get personal benefit with limited claim allow per visit. IF you exceed the bill then you will need to payback to company.

shouldnt there be a standard benefit for all staffs when comes to health and medical benefits ..(same benefit for all grade because we talking about life and everybody should be equal on this area.)

If we go and see chinese medical clinic, is it claimable? or we cant claim due to malaysia labour rule?

Is because already went to see normal clinic twice but no improvement so decide to see chinese doctor.

As far as I know, Chinese physicians (sinseh) are not registered medical practitioners under the Medical Act 1971 and therefore they are not recognized under the Employment Act. Therefore, you cannot claim.
